NOTICE IS HEREBY GIVEN that by virtue of a certain Purchase Money Deed of Trust, dated July 13, 2009, made by Craig L. Newcomer and Melisa J. Smith-Newcomer, to James E. Walsh, as Trustee, to secure Calvin M. Gardner, as Beneficiary, and of record among the Land Records of Allegany County, Maryland, in Liber 1613, Folio 465 (the “Deed of Trust”), in the payment of the maximum principal sum of Fifty Thousand and 00/100 Dollars ($50,000.00), evidenced by a Note, dated July 13, 2009 (the “Note”), and pursuant to the Deed of Trust wherein said Beneficiary was authorized and empowered to remove the trustee appointed in the Deed of Trust and appoint substitute trustees in the place and stead of the trustee named in the Deed of Trust, and the undersigned, Kenneth J. ALL THAT CERTAIN lot, piece, or parcel of ground lying and being in Election District 33, Allegany County, Maryland, and more particularly described as follows:
BEGINNING at a fence post on the West side of the Old County Road from McCoole to Cumberland, also the beginning corner of the 21.5 acre tract of which this is a part, and being also a corner of Henry Carbon’s land, and running thence with said road and an original line of the 43 acre tract of which this was once a part, North 12 degrees West 15 ? poles to a post where the West side of the road meets the South side of the Old County Road from Westernport; thence with the last mentioned road along the South side thereof, South 73 degrees West 9 poles to a stake, thence North 70 degrees West 11 poles to a locust tree on the South side of said road, thence following the South side of the road, North 58 degrees West 19 poles; thence South 68 degrees 45 minutes West 10 poles to a red oak; thence, South 40 degrees 30 minutes West 25.25 poles; thence, South 51 degrees 15 minutes West 20 poles to a point opposite the gateway into the land of the Western Maryland Orchard Company; thence, South 63 degrees West 12 poles; thence, South 47 degrees West 13 poles to a red oak; thence, South 10 degrees 30 minutes West 6 poles to a stump; thence, South 56 degrees 30 minutes East 30 poles to a stone in the Henry Carbon line; thence, North 63 degrees 15 minutes East 83.5 poles to the beginning.
EXCEPTING, however, from the above description, the portion of it that was previously conveyed away by persons in the chain of title.
BEING the same property conveyed unto Craig L. Newcomer and Melissa J. Smith-Newcomer by Deed, dated July 13, 2009, conveyed by Ricky E. Zacot and recorded among the Land Records of Allegany County, Maryland in Liber 1613, folio 461.
The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases, and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes assessed against said property, and to any further matters announced at said sale.
The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of record, if any, having priority over the Deed of Trust.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustees reserve the right to reject any or all bids.
