TRUSTEE'S SALE

Trustee's Sale of valuable fee simple property improved by premises known as 310 Pulaski St, Cumberland, MD 21502. By virtue of the power and authority contained in a Deed of Trust from DONALD R. HEINRICH, JR., dated January 23, 2009, and recorded in Liber 1556 at Page 169 among the land records of the County of Allegany, in the original principal amount of $87,000.00. Upon default and request for sale, the undersigned trustees will offer for sale at public auction at the Courthouse for the COUNTY OF ALLEGANY, at 30 Washington Street, Cumberland, Maryland, on May 24, 2017 at 4:00 PM, all that property described in said Deed of Trust including but not limited to:
All those two lots or parcels of ground lying and being in the City of Cumberland, in Allegany County, Maryland, and known and designated as Lots Nos. 29 and 30 in Fairview Addition to Cumberland, and more particularly described as follows:
(1) BEGINNING for said Lot No. 29 on the Westerly side of Pulaski Street at the end of the first line of Lot No. 28 in said Addition, said point of beginning being 30 feet distant from the end of the first line of Lot No. 27 in said Addition, heretofore conveyed to Henry Appel by Deed recorded among the Land Records of Allegany County in Liber No. 77, page 50; and running thence with Pulaski Street, North 20-5/6 degrees East 30 feet; thence North 69-1/6 degrees West 100 feet to an alley; and with it, South 20-5/6 degrees West 30 feet to the end of the second line of Lot No. 28; and with it reversed, South 69-1/6 degrees East 100 feet to the BEGINNING.
(2) BEGINNING for said Lot No. 30 on the Westerly side of Pulaski Street at the end of the first line of Lot No. 29, herein described, and running thence with Pulaski Street, North 20-5/6 degrees East 30 feet; thence North 69-1/6 degrees West 100 feet to an alley; and with it, South 20-5/6 degrees West 30 feet to the end of the second line of Lot No. 29; and with it reversed, South 69-1/6 degrees East 100 feet to the BEGINNING.
Said property is in fee simple and is improved by a dwelling and is sold in "as is condition" and subject to all superior covenants, conditions, liens, restrictions, easement, rights-of-way, as may affect same, if any.
TERMS OF SALE: A deposit of 10% of the sale price, cash or certified funds shall be required at the time of sale. The balance of the purchase price with interest at 6.00% per annum from the date of sale to the date of payment will be paid within TEN DAYS after the final ratification of the sale. Adjustments on all taxes, public charges and special or regular assessments will be made as of the date of sale and thereafter assumed by purchaser. If applicable, condominium and/or homeowners association dues and assessments that may become due after the time of sale will be the responsibility of the purchaser. Title examination, conveyancing, state revenue stamps, transfer taxes, title insurance, and all other costs incident to settlement are to be paid by the purchaser. Time is of the essence for the purchaser, otherwise the deposit will be forfeited and the property may be resold at risk and costs of the defaulting purchaser. If the sale is not ratified or if the Substitute Trustees are unable to convey marketable title in accord with these terms of sale, the purchaser's only remedy is the return of the deposit.
